Welcome to MK1wear. The terms “we”, “us” and “our” refer to MK1wear.
MK1wear operates this website and online store, including all related information, content, features, tools, products and services (the “Services”). MK1wear uses Shopify to power its online store and provide the Services.

These Terms of Service (“Terms”), together with any policies referenced herein, set out your rights and responsibilities when using our Services.

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

You may be required to provide accurate, current and complete information, including billing, payment and delivery details. You confirm that all information you provide is correct and that you are authorised to use any payment method submitted.

We make every effort to display products accurately. However, colours and appearance may vary depending on your device and settings.

Product descriptions and availability may change at any time without notice. We reserve the right to discontinue or limit the supply of any product.

SECTION 3 – ORDERS

By placing an order, you make an offer to purchase products from MK1wear. An order is only accepted once we send you an order confirmation email.

Payment must be received in full before an order is accepted. Once accepted, orders may not be cancelled except in accordance with your statutory cancellation rights and our Returns Policy.

All purchases are subject to our Returns Policy. Products are sold for personal use only and not for resale.

SECTION 4 – PRICES AND PAYMENT

All prices are shown in GBP (£) and include VAT unless stated otherwise. Delivery charges are displayed at checkout.

Prices and promotions may change at any time but will not affect orders already accepted.

You agree to provide accurate payment and account details and authorise us to charge your selected payment method.

SECTION 5 – DELIVERY

Delivery times are estimates only. We are not responsible for delays caused by events outside our reasonable control.

Risk in the goods passes to you upon delivery, in accordance with UK consumer law. Ownership transfers once payment has been received in full.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services, including text, images, logos, graphics and design, is owned by or licensed to MK1wear & MK1 Gym Ltd and is protected by UK intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You must not copy, reproduce, distribute or exploit any content without our written permission.

“MK1wear” and associated branding are trademarks of MK1 Gym Ltd Shopify trademarks belong to Shopify Inc.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available”. We do not control or endorse these tools and are not responsible for their use.

Your use of optional third-party tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

Our Services may include links to third-party websites. We are not responsible for the content, policies or practices of third-party sites. Accessing third-party sites is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

MK1wear uses Shopify to operate its online store. All purchases are made directly with MK1wear, not Shopify. Shopify has no responsibility for sales or disputes between you and MK1wear.

SECTION 10 – PRIVACY

Your personal data is handled in accordance with our Privacy Policy and applicable UK data protection laws. Shopify may also process data as part of providing the Services.

SECTION 11 – FEEDBACK

If you submit feedback, reviews or suggestions, you grant MK1wear a royalty-free, perpetual licence to use that content for business purposes. You confirm that your feedback is lawful and does not infringe third-party rights.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct errors or inaccuracies and to cancel orders if information is incorrect. This does not affect your statutory rights.

You agree to indemnify MK1wear against losses arising from your breach of these Terms or misuse of the Services.

If any provision is found unenforceable, the remaining provisions will remain in effect.

These Terms and referenced policies constitute the entire agreement between you and MK1wear.

You may not assign these Terms without our consent. We may assign our rights at any time.

SECTION 21 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

Headings are for convenience only and do not affect interpretation.

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
